1. What is Family Dispute Resolution (FDR)?
Family Dispute Resolution (FDR) is a mediation process that helps separated or divorcing parents and families resolve disputes about parenting, property, and other family matters without going to court.
2. Is mediation legally binding?
Agreements reached in mediation are not automatically legally binding. However, they can be formalized through a Parenting Plan or a legally enforceable Consent Order.
4. Do I need to have a lawyer for mediation?
While you don’t need a lawyer to participate in mediation, it can be helpful to seek independent legal advice before and after mediation to understand your rights and options.
5. Why should I choose Beyond Mediation?
Beyond Mediation focuses on co-parenting, child-focused solutions, and moving beyond conflict to create sustainable and practical agreements that benefit everyone involved.
6. How does the mediation process work?
The process typically involves:
- An intake session (individual consultation) to assess suitability
- Joint mediation sessions (if appropriate)
- Creating agreements that focus on the best interests of the child
7. What happens if mediation doesn’t work?
If mediation is unsuccessful, we can issue a Section 60I Certificate, which is required before applying to the Family Court for parenting orders.
8. What if I cannot afford the mediation fee?
We understand that you may be going through financial hardship and we do not want this to hinder your access to our services. Apply for our financial subsidy program to be eligible for reduced costs on our services.
9. What is Islamic Guided Mediation?
Islamic Guided Mediation is a family dispute resolution process that includes the presence of a Religious Advisor to provide guidance based on Islamic principles, alongside a registered Family Dispute Resolution Practitioner (FDRP) who facilitates the mediation.
10. Is the Religious Advisor the decision-maker?
No. The Religious Advisor provides spiritual and ethical guidance only. The FDRP remains neutral and manages the process. All final decisions are made by the participants themselves.
11. Can I bring my own Religious Advisor?
Beyond Mediation has selected a panel of Religious Advisors who have been briefed on the process of Islamic Guided Mediations. Parties will have to choose a Religious Advisor from the panel.
12. What is Post-Mediation Counselling?
This is a one-off counselling session offered to help parents explain mediation outcomes to their children and support the smooth implementation of the agreement.
13. Who facilitates the post mediation counselling session?
The session is facilitated by a qualified psychologist experienced in working with separating families.
